Senate Faces Sept. 15 Procedural Vote on CLARITY Act Crypto Rules

Sen. Cynthia Lummis stated on X on Sept. 6 that if the CLARITY Act does not pass in the current Congress, the next realistic opportunity for crypto market-structure legislation will not arrive until 2030.

The Senate is scheduled to hold a procedural vote on the bill on Sept. 15. The measure passed the House in July 2025 and has remained in the Senate for more than a year.

What remains open

The bill aims to set criteria that distinguish digital assets as securities versus commodities and to clarify which regulator, the SEC or the CFTC, oversees each market.

Unresolved provisions cover ethics, law-enforcement, and market-integrity requirements. The Sept. 15 vote addresses cloture to end debate rather than final passage, and whether the bill can clear both chambers before the November midterms remains uncertain.
