Judge Dismisses Solana Labs Claims in Pump Fun Lawsuit

U.S. District Judge Colleen McMahon dismissed all claims brought by Burwick Law against Solana Labs, the Solana Foundation, and their executives in the Pump Fun litigation.
The ruling leaves the case focused on Baton Corporation, the parent of Pump Fun, and four named executives: Noah Bernhard, Hugo Tweedale, Alon Cohen, and Dylan Kerler.
Remaining claims and deadlines
Racketeering claims under RICO were upheld for plaintiffs Carnahan and Okafor but dismissed for plaintiff Aguilar.
Allegations that the FRED and GRIFFAIN memecoins qualify as unregistered securities were dismissed after the court found they failed the Howey Test for a common enterprise.
Burwick Law must file an explanation by September 10 showing why claims against 25 unnamed key opinion leaders should not be dismissed for failure to serve process.
Open questions
The scope of the surviving claims against Baton Corporation and its executives remains to be determined. Any appeals or amended filings have not yet been disclosed.
