ASIC ends no-action relief on 30 September 2026, requiring digital-asset firms to secure or vary AFS licences or face penalties up to 10% of turnover from 1 October.
Australia’s corporate regulator ASIC has set 30 September 2026 as the final date for digital-asset firms to apply for or vary an Australian Financial Services licence under its current no-action position.
From 1 October 2026, firms that fail to meet the conditions face civil and criminal penalties that can reach 10 percent of annual turnover.
Transition gap and application trends
The deadline was extended three months from the original 30 June 2026 date. ASIC recorded an increase in relevant licence applications from about 30 to more than 45 after the extension.
The new Digital Assets Framework Act is scheduled to commence in April 2027, creating a gap of more than six months after the no-action position ends.

The exact number of firms still relying on the no-action position remains unknown. Individual application outcomes and any granted variations have not been disclosed. Specific enforcement actions or fine calculations after 1 October have not been detailed.
