What remains open
The amendment keeps open the regulatory question of whether a spot Ethereum ETF can include staking features that generate yield for fund holders.
The SEC has not approved staking inside spot Ethereum ETFs. The filing is a proposal that sets out how Bitwise would handle validator selection, custody, slashing penalties, and reward distribution if the feature were later permitted.
